The Nirbhaya case becomes the 5th case in 21st century India where the culprits have been hanged till death.
Prior to this, first in this century was rapist and murderer Dhananjoy Chatterjee in 2004, 26/11 terrorist Ajmal Kasab in 2012, Parliament attacker terrorist Afzal Guru in 2013 and Mumbai Bomblast financer Yakoob Memom in 2015.
Out of these names, Ajmal Kasab is the only one whose death penalty is not questioned repetitively.
Dhananjoy Chatterjee even has a movie on him.
People who are about to go abusing Adv. A.P. Singh for defending them till his own capacity’s brink, well, he will be the reason why in future no one can say that the accused weren’t allowed a judicious trial.
For eg. In Vidya Jain murder case, both the people executed are said to be executed only because they were too poor to afford a good lawyer who could bag them a proper trial.
(Vidya Jains husband who was also the man who hired both the killers was a personal eye surgeon of the then Indian President Dr. V.V Giri, and was not sentenced to death penalty although he was the mastermind.)
Similarly, in Nithari Kand, it is said that Surinder Koli was given a death penalty because the lawyer wasn’t too interested in him for saving his life.
Like this there are 400+ cases in which people have gone from ‘convicted with death penalty to acquitted.
You see, the journey from being sent to death penalty to being set free comes with a fling of multiple petitions, trying everything one can to ensure that justice is served. If there is an opportunity to file, they should file until The End.
In fact, Balbir Singh in the Indira Gandhi assassination was acquitted at 11th hour ONLY.
It took 8 years for the justice to be delivered, it was a bit delayed (if you know Indian Justice system you’d know that 8 years is nothing actually, because there are people who begin cases at their youth and die at 89; still filling for petitions and leave their stay on this planet undone) but it just ensured that in future NO ONE can say that the 4 convicts were sent to death because they were poor and couldn’t afford a better lawyer (like in Vidya Jain murder case), like in Nithari Kand (the lawyer wasn’t interested) , it was given to public conscience (Yakoob Memom, Afzal Guru, Maqbool Butt), or that the judgement was faulty (Dhananjay Chatterjee)
Kasabs judgement was untainted, he had the best lawyers, Raju Ramchandran, who at the end of the judgement said : “I bow to the verdict of the court. As amicus curiae, I was given an opportunity to advance every convincing arguments, I could.”
Took 8 rigorous long years, but I hope it goes down in the history of India as the most fair case that led to death penalty.
